CONSUMER RIGHTS – WITHDRAWAL – CANCELLATION AND REFUND CONDITIONS

If you place an order electronically through the website you are using, you are deemed to have accepted the pre-information form and the distance sales contract presented to you.

Buyers are subject to the provisions of the Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts (Official Gazette: 27.11.2014/29188) regarding the sale and delivery of the products they purchase, as well as to other current laws.

The shipping cost, including the freight charges, will be paid by the buyers.

Each purchased product is delivered to the person and/or organization at the address indicated by the buyer, without exceeding the legal period of 30 days. If the product is not delivered within this period, buyers can terminate the contract.

The purchased product must be delivered in full, in accordance with the specifications specified in the order, and with documents such as the warranty certificate and user manual, if any.

In case the sale of the purchased product becomes impossible, the seller must notify the buyer in writing within 3 days from the moment they learn of this situation. The total price must be refunded to the Buyer within 14 days.

IF THE PURCHASE PRICE OF THE PRODUCT IS NOT PAID:

If the buyer does not pay the price of the purchased product or cancels it in bank records, the Seller’s obligation to deliver the product ends.

TRANSACTIONS MADE WITH THE UNAUTHORIZED USE OF A CREDIT CARD:

If it is determined that the credit card used for payment by the buyer has been unjustly used by unauthorized persons after the delivery of the product and if the product price is not paid to the Seller by the relevant bank or financial institution, the Buyer must return the product to the SELLER within 3 days at the SELLER’s shipping expense.

IF THE PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORESEEABLE REASONS:

If force majeure events that the Seller could not foresee occur and the product cannot be delivered on time, the situation will be notified to the Buyer. The Buyer can request the cancellation of the order, replacement of the product with a similar one, or postponement of delivery until the obstacle is removed. If the Buyer cancels the order; if the payment was made in cash, this amount will be paid back to him in cash within 14 days from the cancellation. If the Buyer has made the payment by credit card and cancels it, the product price will be refunded to the bank within 14 days from the cancellation, but it may take 2-3 weeks for the bank to transfer it to the buyer’s account.

THE OBLIGATION OF THE BUYER TO INSPECT THE PRODUCT:

The Buyer shall inspect the contract goods/service before receiving them; damaged, broken, torn packaging, etc. will not accept the delivery of damaged and defective goods/service from the cargo company. The goods/service received will be considered undamaged and intact. The BUYER must carefully protect the goods/service after delivery. If the right of withdrawal is to be exercised, the goods/service should not be used. The Invoice must also be returned with the product.

RIGHT OF WITHDRAWAL:

The BUYER can exercise the right to withdraw from the contract by rejecting the goods without taking on any legal and penal responsibility and without providing any reason, within 14 (fourteen) days from the date the product is delivered to him/her or the person/organization at the address indicated, provided that the SELLER is notified through the contact information below.

DURATION OF THE WITHDRAWAL RIGHT:

For the Buyer, if the purchase is a service, this 14-day period starts from the date the contract is signed. The right of withdrawal cannot be exercised in service contracts where the service is started with the approval of the consumer before the expiration of the right of withdrawal period.

The costs arising from the use of the right of withdrawal belong to the SELLER.

To exercise the right of withdrawal, it is required to make a written notification to the SELLER by registered mail, fax, or email within 14 (fourteen) days and the product should not have been used in accordance with the provisions of “Products that Cannot be Returned” regulated in this contract.

EXERCISING THE RIGHT OF WITHDRAWAL:

The invoice of the product delivered to the third party or the BUYER, (If the product to be returned is billed to a corporation, it must be sent with the return invoice issued by the institution when being returned. Orders billed in the name of institutions cannot be completed unless a RETURN INVOICE is issued.)

Return form, The box of the product to be returned, packaging, if any, its standard accessories, and if any, must be delivered complete and undamaged along with its standard accessories.

RETURN CONDITIONS:

The SELLER is obliged to return the total price and any documents that put the BUYER under obligation to the BUYER within at most 10 days after the withdrawal notification reaches them and to take back the goods within 20 days.

If a decrease in the value of the goods occurs due to a reason caused by the BUYER’s fault or if the return becomes impossible, the BUYER is liable to compensate the damages of the SELLER in proportion to his/her fault. However, the BUYER is not responsible for the changes and deteriorations that occur due to the proper use of the goods or product within the right of withdrawal period.

If the campaign limit amount set by the SELLER is fallen below due to the exercise of the right of withdrawal, the amount of discount benefited within the scope of the campaign is cancelled.

PRODUCTS THAT CANNOT BE RETURNED:

Goods that are prepared in line with the consumer’s request or clearly personal needs and which are not suitable for return, single-use products, products that are at risk of deterioration or that are likely to expire, goods which are not suitable for return due to health and hygiene reasons if the package is opened by the consumer after delivery, products that are mixed with other products after delivery and cannot be separated due to their nature, goods related to periodicals such as newspapers and magazines, except for those provided under the subscription agreement, services performed instantly in the electronic environment or intangible goods delivered instantly to the consumer, and if the package of the sound or video recordings, books, digital content, data recording and storage devices, computer consumables is opened by the CONSUMER, returns are not possible according to the Regulation. Moreover, the right of withdrawal cannot be exercised for services started with the consumer’s approval before the end of the withdrawal period.

DEFAULT STATE AND LEGAL CONSEQUENCES

If the BUYER defaults in the payment transactions made with a credit card, he/she agrees, declares, and undertakes that he/she will pay interest within the framework of the credit card agreement made with the cardholder bank and will be liable to the bank. In this case, the bank may take legal action; may demand the expenses and attorney’s fee from the BUYER, and in any case, if the BUYER defaults on his/her debt, the BUYER agrees to pay the damages and losses suffered by the SELLER due to the delayed performance of the debt.
